The potential consequences of negligence

A negligent medical professional can cause injury to both the mother and the child. Some of the more common cases of delivery and labor negligence involve:

  • Failure to monitor the child for signs of fetal distress
  • Failure to perform a C-section in a timely manner
  • Use of excessive force, resulting in skull fractures or brachial plexus injuries
  • Forceps errors leading to skull fracture and brain trauma
  • Vacuum extractor errors
  • Failure to notice an umbilical cord wrapped around the child’s neck
  • Failure to diagnose Cephalo-Pelvic-Disproportion (CPD)
  • Failure to administer antibiotics, epidurals or Pitocin correctly
  • Failure to protect the child from infections transmitted by the mother, such as GBS or HIV

One of the biggest risks a newborn faces because of labor and delivery errors is brain damage. Oxygen deprivation is a serious concern during any delivery, but especially for difficult or high-risk births; such deliveries can be exacerbated by medical negligence. A wrapped umbilical cord (“nuchal cord”), an incorrect dosage of drugs or a delay in recognizing the signs of fetal distress could cause permanent and severe brain damage in the infant.
