Surgical errors in the evaluation of medical negligence is important, but here’s the most important thing: individuals comes after they’ve had a bad surgery. There’s a bad result. That doesn’t necessarily mean there’s medical negligence. You have to get the medical records, and look at the anesthesia records, and especially the surgical records: the operative report. That will tell you whether or not you had simply a bad outcome – which does occur – or whether the surgeon or the anesthesiologist in the case, were negligent, leading to that bad result. But until you look at the medical records, you’re not sure if it’s bad results or negligence, which is often the case.

Surgeons make mistakes more often than you might think. If the error is caught quickly, fixed immediately, and leads to no lasting effects, you may not be able to make a claim for compensation. That is because a successful medical malpractice claim must prove:

  1. The doctor owed a duty of care to the patient.

  2. The doctor behaved negligently, or failed to live up to that duty of care.

  3. The failure or breach of duty was responsible for the injuries sustained by the patient.

  4. The injuries led to certain kinds of damage, such as loss of income, medical bills or pain and suffering.

If these criteria are met, then you can make a claim against the surgeon or anesthesiologist – or any medical professional – whose negligence led to your injuries.
