Is every bad medical outcome evidence of medical malpractice?
No, it is not. Bad outcomes frequently occur even when doctors do everything right. Conversely, a patient may suffer no harm despite a doctor making a huge mistake. There are several criteria that must be met for a case to be considered medical malpractice. First, there must be a duty of care such as a doctor-patient relationship.
Second, the physician must have violated that duty by deviating from the expected standard of care – that is, the care that another competent professional would have provided under the same circumstances. Finally, the patient must have suffered injury/death and other damages as a direct result of the physician’s breach of duty.
Can any personal injury attorney represent me in a med mal claim?
Legally speaking, any attorney could represent you in a med mal claim. However, many personal injury attorneys lack the knowledge, time, resources and tenacity to take on these cases. Med mal litigation is often very complex, and it requires considerable research, document review, consultation with medical experts and the ability to make a compelling case in the courtroom.
