Answers To Common Questions About Medical Malpractice

Below, we’ve provided answers to questions we often receive from prospective clients. We invite you to contact us if you have additional questions or want to learn more about how we can help you.

Is every bad medical outcome evidence of medical malpractice?

No, it is not. Bad outcomes frequently occur even when doctors do everything right. Conversely, a patient may suffer no harm despite a doctor making a huge mistake. There are several criteria that must be met for a case to be considered medical malpractice. First, there must be a duty of care such as a doctor-patient relationship.

Second, the physician must have violated that duty by deviating from the expected standard of care – that is, the care that another competent professional would have provided under the same circumstances. Finally, the patient must have suffered injury/death and other damages as a direct result of the physician’s breach of duty.

Can any personal injury attorney represent me in a med mal claim?

Legally speaking, any attorney could represent you in a med mal claim. However, many personal injury attorneys lack the knowledge, time, resources and tenacity to take on these cases. Med mal litigation is often very complex, and it requires considerable research, document review, consultation with medical experts and the ability to make a compelling case in the courtroom.

Many personal injury attorneys don’t accept medical malpractice claims for these reasons, and those who “dabble” in med mal may be ill equipped to give your case the resources it deserves. Our firm proudly and eagerly takes medical malpractice claims, and we have a strong track record of success on behalf of clients.

Who may be liable for medical malpractice in addition to a physician or nurse?

Other medical professionals sometimes make mistakes that result in patient harm. One example would be pharmacists who fill the wrong prescription or administer the wrong dose. Specialists like anesthesiologists or radiologists are also commonly named in med mal claims. They are physicians, but they don’t regularly interact with the patients they treat.

Finally, whenever a medical professional is named in a med mal complaint, the hospital or clinic employing that professional may be jointly liable.

The hospital won’t talk to me. Can your firm help me get answers?

Sadly, this experience is very common. Hospitals are afraid of getting sued by saying anything that could suggest liability, so they shut down all communication with patients and their families after a serious medical mistake has occurred. Ironically, in doing so, they often prompt these families to seek an attorney’s help just to get answers or an explanation.

We are not able to take every case that comes to us. But if we do take your case, we will do everything in our power to help you find the answers, accountability and compensation you’re looking for.
