In July 2014, a mother and her child attended a Dayton Dragons game. They had received free tickets for seats behind the first base dugout. The players in the first base dugout were protected by safety netting, but the young boy and his mother, sitting just a few feet away, were not. A foul ball struck the boy in the head; the high-speed projectile caused severe, traumatic brain injury.

The family has incurred more than $350,000 in medical expenses on behalf of their young son, who has undergone multiple brain surgeries and is permanently disabled. They retained Crandall & Pera Law's own Marc Pera to represent them.

WKRC Cincinnati’s Local 12 reported, “The Dayton Dragons tickets have a warning on the back, just like other team tickets including the Reds. In very small print it said the ticket holder assumed all risk of being injured by thrown bats or thrown balls. The suit included a baseball study. It showed if within a hundred feet of home plate a ball comes at a person 90 miles an hour it is going to hit a person in less than a second.”
