Investigating Birth Injuries

A birth injury case starts with one of the most dreaded things in anyone’s life and that is an injury to a child. But what people don't realize initially is that injury to the child could actually have happened during the various stages of the pregnancy. So, an evaluation of the prenatal period, which is before the delivery occurs, as well as during the labor and delivery and even after the baby is born, that evaluation has to take place from start to finish.

Anytime a family comes to me for investigation of a birth injury case, the electronic fetal monitoring strips are very important. Initially, when you look at these strips, and they're actually records that are created during the labor and delivery process, it shows the baby’s heart rate, it shows Mom’s contraction pattern. When you first look at them they look complicated. But actually when you sit down and review them with a family, you see that it is very common sense.

It shows the baby’s heart rate, so you can evaluate whether the baby is healthy, whether the baby is undergoing distress during the labor such that the doctor should intervene. It also shows Mom’s contraction pattern, so you can also see if the contractions were strong, whether they are adequate, or whether there are too many of those contractions, which can also affect the baby.

So when I sit down with the baby family and review the electronic fetal monitoring strips themselves, they can actually see what occurred during the labor and delivery and they can get the answers to what happened to their baby by reviewing those strips together.
