Crandall & Pera’s $10.3M verdict against Ethicon affirmed by Court of Appeals

More than a year ago, Crandall & Pera partner Marc Pera achieved a $10.3 million verdict for client Nikki Simon. Ms. Simon faced a surgical injury involving an Ethicon surgical stapler, wherein doctors were forced to remove portions of her colon to save her life. After this malfunction and the ensuing medical care it required, Ms. Simon is forced to rely on a colostomy bag for the rest of her life.

Prior to this initial verdict, Ethicon continually delayed the process of obtaining compensation, offering up numerous other theories and blaming the surgeon for the accident. They refused to accept responsibility, and this pattern continued after receiving the verdict that placed their device at fault. Ethicon has continually delayed and appealed the case, forcing Ms. Simon to continue to wait for the compensation she deserves and needs for her care and that of her family.

After over a year of delay caused by the defendant’s continued appeals of the case, a 2021 verdict achieved by Crandall & Pera partner Marc Pera now stands affirmed due to the Supreme Court of Ohio’s refusal to hear Ethicon’s appeal. We are pleased that the verdict we achieve will stand and that Nikki Simon will finally be able to move on.
