Negligent Neurosurgery

Jim Layden was a librarian in his 50s when he began to experience difficulty walking and with his speech. He was eventually diagnosed with hydrocephalus, a condition where cerebrospinal fluid does not properly drain from the brain down into the spinal canal. Two proven and relatively common procedures are well known to successfully treat this condition; the patients go on to live a full and complete life with very few side effects. In Jim’s case, his neurosurgeon introduced a risky and less common procedure, for the first time on the day of surgery. This surgery was pushed onto Jim by his surgeon, despite being very risky. The surgery was also mis-represented and not explained properly to Jim. Unfortunately this negligently chosen surgery resulted in permanent damage to Jim’s brain, which has rendered him unable to work and unable to properly care for himself. After a lawsuit was filed by Crandall & Pera Law, founding partner Steve Crandall, a settlement for $4M was eventually paid by the neurosurgeon. These funds will allow Jim to remain at the care facility he prefers and provide for greater medical care and therapy than he was receiving.

Every case is different, and the verdicts and settlement figures listed by Crandall & Pera Law are not a guarantee of similar outcomes for other clients and cases.
